Honolulu, Hawaii is a gateway for China to transit copious amounts of illegal fireworks coming into this country. Our police department needs a resource expert in fireworks laws in order to modify our current legal definitions. We may also need training in giving expert testimony for the prosecution of cases.
The Honolulu Prosecutor's Office has stated they will not prosecute any firework related offenses, because the local Police Department (HPD) doesn’t have anyone to testify to the 1.3/1.4 designations utilized by the U.S. Department of Transportation. Instead the HPD postulates that it could propose a rewrite of the current laws to remove the 1.3/1.4 definitions and replace it with language that describes a firework in a mechanical way. However, we would then need training in giving expert testimony as to its design. Our forensic lab can only give expert testimony regarding trace evidence of the compounds employed.
Need a resource to re-write fireworks laws to update portions of our local and state laws regarding the 1.3 and 1.4 designations utilized by the U.S. Dept of Transportation.
Also need expert witness training.
Currently our Prosecutor will not prosecute any firework-related offense due to our PD's inability to present expert testimony. .
